"Dear Vivian" Privacy Policy: Derrer is committed to protecting privacy rights
Derrer Marketing Ltd.'s ("Derrer") respects privacy rights. This privacy policy governs personal information gathered by Derrer through the Dear Vivian service, and related services, available at Dearvivian.com and Derrer.ca.
The Dear Vivian service is intended to build stronger relationships between local businesses and their consumers by:
1) giving consumers the opportunity to give their feedback to local businesses, and
2) giving local businesses the opportunity to respond to consumer complaints, comments and suggestions.
At times our services involve the handling of personal information.
Derrer's Commitment to Safeguarding your Information
Physical, technical, electronic and managerial procedures have been employed to safeguard the security, integrity, and when applicable, the anonymity or confidentiality of personal information and business information collected by Derrer. To protect the security of information supplied and accessed by businesses, businesses are provided user names and passwords* to access their information and to access the feedback left for them by consumers.
*Each business is solely responsible for the security of its password, and shall take precautions to keep its password private to prevent any unauthorized use. Neither Derrer nor any other person or entity will be responsible for any losses, damages or consequences suffered due to careless or unauthorized use of a password.
Personal Information that Derrer May Collect Online
(a) From Consumers
Derrer may collect personal information from consumers online, including names, cities of residence, phone numbers, email addresses, and feedback information (including complaints, comments and suggestions).
(b) From Businesses
Derrer may also collect business information from businesses that apply for membership and participation in the Dear Vivian service. Some of the information Derrer collects from businesses may constitute personal information of customers (for example, if a business' posting relates to a particular customer), as well as personal information from individuals acting solely in their business capacity.
(c) Avoiding collection from Children
Derrer does not knowingly collect or maintain any personal information from children under the age of 13. In addition, no part of our site is designed with the purpose of attracting any person under age 13.
How Derrer Uses Personal Information Collected Online
We use your personal information only for the purposes for which it is submitted, such as to reply to your emails, handle your feedback, deliver our Newsletter, tell your friends about our site, and process billing and business requests related to participation in the Dear Vivian service, or related services offered at DearVivian.com.
The information that we collect from you is also used in the following ways:
• to reach you to resolve any problems should they arise in connection with your use of our service,
• to better understand your needs and interests,
• to analyze the success of our services,
• to customize the content on our site for our visitors current and future needs, and
• to customize our communications with you.
At certain points where personal information is collected on our site, there may be a box where you may indicate you would like to be on a mailing list to receive information about other Derrer programs and services and about ways to support the Derrer. At any time you can add or remove your name from a Derrer list by contacting us at PrivacyOfficer@DearVivian.com.
Derrer uses data collected through the site to conduct research on marketplace practices and local consumer-business relationship trends. Derrer's research may lead to the publication of aggregate data, including publication in our Newsletter, but will not result in the reporting or publication of any personal information provided to us.
How Your Information May Be Shared
(a) with Businesses
Whenever you, as a consumer, provide feedback about a particular business on our site, you will have the option to remain anonymous or to provide your personal information (namely your name, email and phone number) to be associated with your feedback.
If you remain anonymous, your feedback will be forwarded to the appropriate business, which may publicly post your feedback on DearVivian.com, and reply to it publicly.
If you provide your personal information after submitting your feedback, your personal information along with your feedback will be disclosed to the particular business to which it relates so that it may contact you to address your feedback. The business may publicly post and reply to your feedback on DearVivian.com, but the business is prohibited from publicly posting your personal information.
By completing Derrer's Feedback form and by providing your personal information with your feedback, you are consenting to Derrer forwarding your feedback and your personal information to the appropriate business.
If you do not wish for a particular business to be able to identify you as the source of feedback do not provide your personal information after submitting your feedback.
(b) with Service Providers
From time to time, we may hire third parties to assist us with certain functions such as email marketing campaigns.
Whenever we supply data files to third party service providers we take measures to safeguard the security, integrity and confidentiality of personal information. For example, we require our service providers to protect the confidentiality of the data and to use it only for the specific task for which it was given. All files remain property of Derrer.
Our newsletter is handled differently as described below.
(c) with Others
Derrer may also release personal information under the following circumstances:
• Where release is required by law (for example, a subpoena) or regulation or is requested by a government agency;
• Where our records indicate a company may be engaged in fraudulent activity or other deceptive practices that a governmental agency should be made aware of;
• To appropriate governmental authorities, where legally warranted; or
• To appropriate persons, where your communication suggests possible harm to others.
(d) Selling or Renting Your Personal Information
We would never sell or rent your personal information to third parties.
Derrer's Tell A Friend Service
Derrer allows you to tell your friends about us and our services. Prior to using the Tell a Friend feature, you must have the permission to use the email address of the friend that you elect to tell about us and our services.
Derrer's Newsletter and Constant Contact, Inc.
Constant Contact, Inc. ("Constant Contact") handles our newsletter. Constant Contact directly collects personal information from people and businesses wishing to subscribe to the Derrer Newsletter. Constant Contact independently handles all delivery of, and communications related to the delivery of the Derrer Newsletter. Derrer has access to this personal information.
If you subscribe to the Derrer Newsletter, you acknowledge and agree that any personal or other information you submit for the purpose of the newsletter is being disclosed to Constant Contact and will be subject to the Privacy Policies available here: http://ui.constantcontact.com/roving/CCPrivacyPolicy.jsp and here http://www.constantcontact.com/privacy_guarantee.jsp
You release Derrer from any and all liability associated with Constant Contact collection, disclosure and use of your personal information for the purpose of handling the newsletter.
Constant Contact is located in the United States, and any personal information it holds will be subject to the laws of the United States, and may be lawfully accessed by US authorities.
How Long Derrer Retains Personal Information
Derrer has guidelines regarding the retention and destruction of personal information. Personal information is retained as long as necessary to fulfill the purposes for which it was collected and is used, and thereafter is destroyed, erased or anonymized.
Information that consumers or businesses post on the website, will remain part of Derrer's public archive available on this website. If you wish to request that your personal information be removed from a particular public webpage, please send your request to PrivacyOfficer@DearVivian.com.
How to Help Us Keep Your Personal Information Accurate and Obtain Access to the Information Derrer has that Identifies You Personally
As one of our customers, you have the right to request access to the personal information that we hold about you, which includes the right to amend or correct that information, as appropriate, and to receive an account of how it has been used and a list of the organizations to whom it has been disclosed.
To request access to your information or if your personal information changes and you would like to update the personal information we may have on file, please email us your request at PrivacyOfficer@DearVivian.com .
Let us also know what led to your submission of personal information so we may efficiently respond to your request.
Computer Tracking, IP Addresses and Cookies
Our website is not set up to track, collect or distribute personal information not entered by visitors. Our site logs do generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites, browser, operating system and internet service provider information, and other similar information in anonymous aggregate form. This information is used for internal purposes by technical support staff to provide better services to the public and may also be provided to others, but again, the statistics contain no personal information and cannot be used to gather such information.
(a) IP addresses
Our site collects IP addresses to obtain aggregate information on the use of DearVivian.com. An IP address is a number assigned to your computer by a Web server when you are on the web. When you are on our site, we have a back-end server that logs your computer's IP address. We only use IP addresses in the aggregate, and not to track a specific IP address to identify an individual user. However, we may use such information to identify a user if we feel that there are or may be safety and/or security issues or to comply with legal requirements.
(b) Cookies
A cookie is a small amount of data that is sent to your browser from a Web server and stored on your computer's hard drive. Derrer uses non-identifying cookies to provide easier site navigation and access to forms. You can still use the Derrer sites if your browser is set to reject cookies. Our cookies do not generate personal data, do not read personal data from your machine and are never tied to anything that could be used to identify you.
Links to other sites
Visitors will find links from DearVivian.com and Derrer.ca to independently owned, controlled and/or managed World Wide Web or Internet sites whose content we have found of possible interest to our visitors. While we initially visit these sites to which we directly link, we do not monitor or control the content that appears on these sites and such content may be constantly changing. Read the privacy policies of all linked sites before navigating through them.
Problems or Complaints with Derrer Privacy Policy
If you have a complaint about Derrer's handling of your personal information, you may contact us at PrivacyOfficer@DearVivian.com . We will do our best to resolve any outstanding issues in a positive and co-operative spirit, and in a prompt manner. If, having shared your concerns with us, you are still not satisfied, you may file a complaint with the Privacy Commissioner of Canada by mail to 112 Kent Street, Ottawa, ON K1A 1H3 or by calling 1 800 282 1376.
